Overview

Paneah LLC (“Company,” “we,” “us,” “our”) respects intellectual property rights and complies with the Digital Millennium Copyright Act of 1998 (the “DMCA”).

This policy explains how copyright holders can report alleged infringement of works appearing on properties operated by Paneah LLC — including paolavilla.com, paneah.com, paolavilla.store, Sword Edge (newsletter, YouTube, membership), Paneah software products, and any other website, application, or platform operated by Paneah LLC — the process we follow to address such claims, and the rights of users to dispute takedown notices.

Penalties for False Claims. The DMCA requires that notices of infringement be sworn to under penalty of perjury. It is a federal crime to intentionally submit false information under penalty of perjury (18 U.S.C. § 1621). Submitting a false DMCA notice can result in criminal liability and civil damages, including liability under 17 U.S.C. § 512(f) for material misrepresentation.

 

Before Sending a Takedown Notice

We encourage copyright holders to:

  • Investigate thoroughly — verify that the use is actually infringing and not authorized by the copyright owner or permitted by law (such as fair use)
  • Consult an attorney — have a legal professional evaluate the facts before submitting a notice
  • Contact the user directly — attempt to resolve the matter with the person or organization using your content
  • Avoid automated services — do not use bots or automated services to submit bulk notices; these are often invalid and result in needless takedowns

 

How to Submit a DMCA Notice

If you believe that copyrighted material owned by you or your client is being infringed on a Paneah property, you may submit a written notice of claimed copyright infringement to our designated Copyright Agent.

Required Information

Your notice must include:

  • Identification of the copyrighted work — describe the copyrighted work you claim has been infringed (e.g., a link to your original work, the original file, or a detailed description)
  • Identification of infringing material — specify the location of the infringing content on our property with enough detail for us to locate it (e.g., direct URL, page identifier, or product page reference)
  • Your contact information — full name, physical address, telephone number, and email address
  • Statement of good faith belief — state: “I have a good faith belief that the use of the material in the manner asserted is not authorized by the copyright owner, its agent, or the law”
  • Accuracy statement and penalty clause — state: “I declare, under penalty of perjury, that the information in this notice is accurate and that I am authorized to act on behalf of the copyright owner”
  • Physical or electronic signature — sign the notice (typing your full name constitutes a valid electronic signature)

How to Submit Your Notice

Physical mail submissions take significantly longer to process. Email is strongly preferred.

By submitting a DMCA notice via email or physical mail, you acknowledge that a copy of your submission — disclosing all information provided — may be shared with the accused party.

 

Our Response Process

Upon receiving a DMCA notice, we will:

  • Review the notice — verify that the notice meets DMCA requirements
  • Notify the user — inform the user or content creator that a DMCA claim has been filed
  • Remove or disable access — take down the allegedly infringing content if the notice is valid
  • Provide the user with the claim — forward a copy of your notice to the user/content creator
  • Wait for counter-notice — allow time for the user to submit a counter-notice if they believe the takedown was improper

 

DMCA Counter-Notice

If your content was removed due to a DMCA notice and you believe the removal was in error, you may submit a counter-notice.

Requirements for a Counter-Notice

Your counter-notice must include:

  • Your contact information — name, physical address, telephone number, email address
  • Identification of removed content — specify the URL or description of the content that was removed
  • Statement under penalty of perjury — state: “I declare, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification”
  • Consent to jurisdiction — state that you consent to the jurisdiction of the U.S. District Court for the judicial district in which Paneah LLC is located, or if outside the United States, any judicial district in which Paneah LLC may be found
  • Acceptance of service — state that you will accept service of process from the copyright claimant
  • Your signature — sign the counter-notice (typing your full name is acceptable)

Submitting a Counter-Notice

Include “DMCA Counter-Notice” in the subject line.

Reinstatement of Content

Upon receipt of a valid counter-notice, we will:

  • Notify the copyright claimant — inform the person who submitted the original DMCA notice
  • Wait for legal action — allow 10–14 business days for the copyright claimant to seek a court order
  • Restore content — if no legal action is taken, we will restore the removed content

If the copyright claimant initiates legal proceedings seeking to restrain the user from engaging in infringing activity, we may not restore the content until the legal matter is resolved.

 

Our Discretion

Paneah LLC exercises limited discretion in evaluating DMCA notices. We determine whether notices meet the minimum legal requirements under the DMCA. We do not make substantive judgments about the merits of copyright infringement claims — that is a matter for the parties and their attorneys to resolve, bearing in mind that notices must be made under penalty of perjury.

 

Repeat Infringers

In accordance with the DMCA, Paneah LLC may terminate the accounts or access privileges of users who are repeat infringers of copyrighted material, in appropriate circumstances and at our sole discretion.

 

Limitation of Liability

Paneah LLC is not liable for:

  • Incorrect removal of non-infringing content based on a facially valid DMCA notice
  • Damages arising from a third party’s submission of a false DMCA notice
  • Damages arising from an invalid DMCA notice
  • The removal of content in compliance with a valid DMCA notice
